(( A By letter of November 17, 1981,* Patti Jacobson, an individual residing in Newburyport, Massachusetts, and ten other individuals seek to intervene in this proceeding.

The petition recites that all of these individuals are " health care providers", with the exception of Ms. Jacobson, no residences are given.

The peti-tioners recite that they are concerned that the licensing of Seabrook will inc:-sase " anxiety" in their " general clientele" which may have adverse physical effects on thic clientele.

For the reacon set forth below, the Applicants, answering pursuant to 10 CFR $ 2.714(c), say that the petition should be denied.

  • No copy was served upon Applicants.

Applicants first obtained the document on November 30, 1981.

6 Prescinding from the question of whether the creation of anxiety a; a result of licensing a nuclear plant can ever be a litigable issue in NRC licensing proceedings," the anxiety here alleged is not that of the petitioners, but that of their clients.

A potential intervenor may assert only his or her own rights.

E.g.',

TVA (Watts Bar Nuclear Plant, Units 1 & 2),

ALAB-413, 5 NRC 1418, 1421 (1977), affirming LBP-77-36, 5 NRC 1292, 1294 (1977).

Further, this anxiety allegation is a classic example of a generalized grievance not distinct to the petitioners.

As the Commission has stated:

"One focus of the ' injury in fact' test is the concept that a claim will not normally be entertained if the ' asserted harm is "a generalized grievance" shared in substantial equal measure by all or a large class of citizens' [ citation].

Thus, even if there is a generalized asserted harm, the Petitioners must still show a distinct and palpable harm to them.
