Dear Mr. Stello:

Your letter (Reference 1) enclosed a Notice of Violation for failure to meet the July 1, 1981 requirement to demonstrate that a prompt public notification system was in place.

This letter constitutes our re.9eonse to the Notice.

i Our letter (Refer-2 2) commented on the adequacy of compensatory actions as follow "In'our opinion, compensating actions have been taken to fulfill'the rule.

These compensatory actions are identified in the Upgraded Emergency Response Plan which was forvarded to your office with Reference (2) on pages F-2 and 6-4.

The siren referred to as a supplement to the emisting plant airen has not been instatted.

The proposed system for notification at LACBWR vitt. consist of a single siren capable of providing a sound tevet of 60 db'in a 1-1/4 mile radius around the facility together uith notification under the direction of the Vernon County, Wisconsin Sheriff.

At the current time, the Sheriff of Vernon. Cou. by has developed and' implemented methods necessary to accomplish this notification.

Because of the 100 L population density of the 5 mile radius _(<1200 people - 55 persons /: aquare mile), ve; have concluded that the plan of the Vernon County . Sheriff constitutes adequate compensatory action.. In the immediate area;near the plant (Village of Genoa, WI, population approximately-300), local residents vill assist the Sheriff in the' notification process. Itlhas notIbeen demonstrated that State / Local officials have the capability to make a public notification decision promptly on being. informed by the licensee of an emergency condition, however, the mechanism for making such a decision was demonstrated;as recently as July 29, 1981 by the Wisconbin Division of Emergency Government during the drill conducted;]Or the[ Zion,,Illinoie nuclear power plant. This capability is discussed in the State of Wisconsin Radiological Response Plan. Demonstration of the capabilities discussed in~10CFR50, Appendix'E, have been scheduled to take place during the week of October 12, 1981." These compensating actions were demonstrated during the practice radiological emergency response. drill conducted yesterday jointly. with Federal, State and local agencies. Our letter (Reference 3) discussed the basis for a diminished initial notification zone for LACBWR as follows: "With regard to Chapter II, Section E, Paragraph 6, the plume-exposure pathuay Emergency Planning Zone is 5 miles in radius. This is consistent with the guidance provided on page 11 of NUREG- -0654 and in'accordance with Reference'9. The initial notification none of the affected' population Uithin the EPZ has been designated as 1-1/4 miles. The basis for this designation is presented in Table G.1." Our letter (Reference 2) discussed the. availability of adminis-trative and physical means for alerting and providing prompt-instructions to the public within the pluma exposure EPZ in the event of an emergency and' stated the following: "The demonstration of the above capability by July 1, 1981 ao set forth in 10CFR50, Appendim E, Section IV.D.3, has not been accom-plished by Dairyland Power Cooperative. " We have been awaiting NRC approval of the Upgraded Radiological Emergency Response Plan and NRC concurrence of the reduced initial - -

1 ) Mr. Victor Stello, Jr. LAC-7879 Director, Office of Inspection and October 22, 1981 Enforcement notification zone prior to procuring and installing a properly sized siren, which in reality plays a relatively small role in early notification. Through our conversations with and observations by NRC personnel, there was sufficient opportunity for awareness that a siren had not been installed by July 1, 1981. There was no action to support lack of candor or frankness on this matter. With the prospect that the diminished initial notification zone will be approved, procurement action will be initiated within the next ten working days to obtain an appropriate siren. Installation and operational status is expected to be achieved, subject to equipment delivery by March 1, 1982. If there are any questions concerning this response, please let us know.
