Enforcement Conference On August 6,1981 at 1:00 PM, Messrs. A. D. Johnson, Director, Enforcement and Investigation Staff, Region V, R. D. Thomas, Chief, Materials Radiation Protection Section, Region V, and J. F. Pang, Radiation Specialist, Region V, held a. formal enforcement conference with the subject licensee concerning the enforcement history of the years 1973, 1978 and the recent inspection in 1981.

This enforcement conference was announced in a letter to the licensee-dated July 31,1981 (copy attached).

Mr. A. Johnson described NRC enforcement policies and procedures and provided licensee representatives with copies of the October 7,1980 Federal Register notice which states the current policy.

Escalated enforcement actions, such as civil penalties, or suspension or revocation of the license were discussed. Mr. Johnson emphasized that Supplements IV and VII of the Federal Register notice were directly applicable to the hospital's proaram.

Mr. R. Thomas discussed the enforcement history as well as the results of the-recent inspection which involved four items of noncompliance.

A copy of Appendix A of the Notice of Violation is attached to this report.

The concern of the repetitive items of noncompliance was s tressed. Mr. Thomas also discussed the need for a tighter management control-program as well as an emphasis on the responsibilities of the radiation safety officer. Concern was also expressed because of the five misadministrations which had occurred since June,1980.

'The licensee was -informed that the Notice of Violation would be the sole ~ enforcement action at this time. However, if the results of an early reinspection show repetition of these items of noncompliance, escalated enforcement actions may be taken.

' Licensee Comments Tha Radiation Safety Officer stated that since the last inspection,

' the following actions have been -taken:

a.

The Radiation Protection Officer holds weekly meetings with the radiation protection office staff during which weekly objectives are communicated'to the office staff. These weekly objectives are also communicated to the Chief of Preventive Medicine.

b.

Another Radiation Safety Technologist has been added to the Radiation Protection Office staff, c.

The executive officer will now perform periodic independent audits of the radiation safety program.

d.

The Radiation Safety Committee will meet on a monthly basis.

Other A question and answer session was held with the licensee's staff present at the meeting. 'Several areas of concern and possible misunderstandings were resolved.

The meeting was adjourned at 2:05 PM.
