The demise of the P116 rim 2 plant at Plymouth, Mass. as described above, taust now be considered as a fateful alternative in the Berwick case. Cancellation of Susquehanna Unit 2 may well be the best solution for the PP&L. Contention 4 explicitly calls for an analysis of such an option. The ASLB has the responsibility to insure that all ar6uments cre heard on this option, and cross-examination takes place in order b

to. obtain as complete a record as possible. Theroforo, the Citizans move the ASLB to deny summary disposition on Contention 4. Its too impo'rtant an issue to try and sweep under the bureaucratic rug.

The Citizens hereby inform the ASLB that new contentions may be filed *oased on new information and the Safety Evaluation Report (SER)

Supplement No. 2 which states that there are still certain unresolved ca fety issues and also items on the NRC agenda that remain "open".

The citizens reserve the riSht, pursuant to the revised NRC rules and reSulations, such as the NRC Statement of Interim Policy, June 13, 1980,

" Nuclear Power Plant Accident Oonsideration Under NEPA;" to file new contentions on the fo110 win 5 items, if they ultimately prove to be unresolved durin6 the course of these proceedinsa. These items include all Outstanding Review Items designated, in Section 1.9 of the SER Supplement 2, as either " resolved pending documentation," " resolved via license condition," or, " additional information reouired." There are ~

thirty-eight such Outstandin6 Review Items at present.

! Also, new contentions may be filed on any of the SER Supplement 2 l

Sections 3 thru 22 if new information reveals that there are serious i

unresolved problems which develop involvin5 public health and safety l cffecting the. issuance of an operation license.
