This is in response to your letters dated June 1,1981, and July 27, 1981 in which you requested a change in existing License Condition 5.2.
This proposed change would permit you to use shipper's tare weights on receipts of uranium oxide on a short term basis until these values can be independently veri fied.
We have determined that granting your request will not adversely affect material safeguards and is otherwise in the public interest. Accordingly, License Condition 6.2 to Amendment No, MPP-2 to your License No. SNM-ll68 is hereby revised, effective immediately, to read as follows:
6.2 Notwithstanding 10 CFR 70.54, for receipts of uranium oxida powder from the Apollo Facility, DOE /NRC Form-741 may be completed and distributed using shipper's tare weight, if necessary, and a cor-rected DOE /NRC Form-741 completed and distributed using receiver's tare weight within 10 days after the last container of a shipment is emptied, except as noted in Section 3.2.1 of the Plan identified in License Condition 2.1.
It has been established that the attachments to your letters dated June 1 and July 27, 1981 contain information of a type specified in 10 CFR 2.790(d).
Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
