MEMORANDUM AND ORDER

On September 21, 1981 theCommissionissueditsauthdrizationforthe Director, Office of Nuclear Reactor Regulation, to issue License No. DPR-76 permitting fuel loading and low-power testing at Diablo Canya Nuclear Power Plant, Unit ), subject to several enumerated conditions. The Commission also ruled that:
However, without taking any view on whether the Board properly excluded Contentions 10 and 12 in its low-power review, the Commission directs the Licensing Board to include them in the full-power proceeding.
The Board, in accordance with the Commission's directive, hereby accepts the Joint Intervenors' previously submitted Contentions 10 and 12, which read as follows:
Contention 10. The Staff recognizes that pressurizer heaters and 9[
associated controls are necessary to maintain natural circulation at 3
hot stand-by conditions. Therefore, this equipment should be clas-p sified as " components important to safety" and required to meet all f
applicable safety-grade design criteria, including but not limited to diversity (GDC 22), sismic and environmental qualification (GDC 1
2 and 4), automatic initiation (GDC 20), separation and independence (GDC 3 and 22), quality assu*ance (GDC 1), adequate, reliable on-site power supplies (DC 17) and tha single failure criterion.
The Appli-cant's proposal to connect two out of four of the heater groups to the present on-site emergency power supplies does not provide an equivalent or acceptable level of protection.

e Contention 12.
Proper operation of power operated relief valves, associated block valves and the instruments and controls for these valvas is essential to mitigate the consequences of accidents.
In addition, their failure can cause or aggravate a LOCA.
Therefore, these valves must be classified as components important to safety and required to meet all safety-grade design criteria.
Discovery will begin immediately upon these contentions.
Close of discovery on these and other admitted inventions will be November 1, 1981.
It is therefore, on this 30th day of September,1981 ORDERED that Joint Intervenor's previously submitted Contention 10 and 12 are accepted for adjudication in the future full-power proceeding.
Discovery shall proceed inmediately and close of discovery on these and previously admitted conten-tions will be November 1,1981.
