J APPENDIX NOTICE OF !IOLATION Dairyland Power Cooperative Docket No. 50-409 Lacrosse Boiling Water Reactor License No. OPR-45 EA 81-81 As a result of the July 29, 1981 submittal from Dairyland Power Cooperative in response to the July 1, 1981 NRC request for information on emergency planning ud in accordance with Interim Enforcement Poli..y, 45 FR 66754 (October 7, 1980),
the following violation was identified:
10 CFR 50.54(s)(2) and Section IV.0.3 of Appendix E, require that by July 1, 1981, each nuclear power reactor licensee demonstrate that administrative and physical means have been established for alerting and providing prompt instructions to the public within the plume exposure pathway of the Emergency Planning Zone within about 15 minutes.
Contrary to the above, Dairyland Power Cooperative was unable to demon-strate that means had been established for alerting and promptly providing public instruction within the plume exposure pathway of the Emergency Planning Zone within about 15 m...utes.
This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Dairyland Power Cooperative is hereby required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, includim-(1) admission or denial of the alleged item of noncompliance; (2) the raasons for the item of noncompliance if admitted; (3) the corrective steps which have been taken and results achieved; IS) corrective steps which will be taken to avoid further items of noncompliance; and (5) the date when full compliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, 42 U.S.C 2232, this response shall be submitted under oath or affirmation.
The responses directed by this Notice are not subject to the clearance procedures of the Office of Managment and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
