Appendix A NOTICE OF VIOLATION Berland Radiology Associates, Ltd.

License No. 24-17715-01 As a result of the inspection conducted on September 11, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

License Condition No. 14 requires that licensed material be possessed and used in accordance with statements, representations, and pro-cedures contained in application dated August 1, 1977; and letters dated September 28, 1977, and November 4, 1977.

The license application dated August 1, 1977, states that the pro-cedures described in Appendix C, Part 6, of the NRC draft licensing guide dated February 1976 shall be followed for calibration of the dose calibrator. Appendix C, Part 6, states that the daily constancy check of the dose calibrator shall include a check of the techne-tium-99m setting. An annual linearity check, annual accuracy check, and a geometrical variation check of the dose calibrator is also required.

Contrary to this requirement, a daily constancy check of the tech-netium-99m setting has not been performed since the date of license issuance. An annual linearity check, annual accuracy check, and a geometrical variation check of the RADX dose calibrator has not been performed.

This is a Severity Level V violation (Supplement VII).

The letter dated September 28, 1977, and the license application dated August 1, 1977, states thvt packages containing radioactive materials shall be surveyed at the surface and at three feet.

Contrary to this requirement, packages containing radioactive materials from Pharmaco Nuclear were not surveyed at three feet.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written 8109290654 810923 ;

l Appendix A 2-statement or explanation in reply, including for each item of noncom-pliance:

(1) corrective action taken and the results achieved; (2) cor-rective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
