On June 5,1980, you filed a petition on behalf.of the City of Gary, Indiana, United Steelworkers of America, Local 6787, the Bailly Alliance, Save the Dunes Council and the Critical Mass Energy Project. to join in the request of the State of Illin6is for. action by the Nuclear Regulatory Comission to suspend or revoke the construction permit for the.Bailly Generating Station, l'ucl ear-1. On August 26, 1981, florthern Indiana Public Service tCompany (NIPSCO) informed my office that the Board of Directo.rs, had decided on that date not to construct the Bailly facility. Based on. that decision, Mr. E. M. Shorb, Executive Vice President of NIPSCO, withdrew NIPSCO's application for an extension of the Bailly construction permit in a le,tter dated August 26, 1981, a copy of which is enclosed. Consequently, no action is required on your request.

Northern Indiana Public Service Company Bailly Generating Station, Nuclear-1 Docket No. 50-367 Construction Permit No. CPPR-104

Dear Mr. Denton:

In May 1974, Construction Permit No. CPPR-104 was issued to Northern Indiana Public Service Company (NIPSCO) for Bailly Generating Station, Nuclear-1 (Bailly).

The Construction Permit cortained a latest date of ccmple-tion of construction et September 1, 1973.

On February 7, 1979, 5:PSCO submitted an application for an extension of the completion date speci.'ied in the Construction Permit for Bailly.

This application was subsequently supplemented by letters dated August 31, 1979, and November 26, 1980.

A proceeding is currently ongoing before the Atomic Safety and Licensing Board regarding the application for an extension.

On August 26, 1981, the Board of Directors of NIPSCO decided not to construct Bailly.
