IIe have received your letter concerning the decommissioning of Indian Point Unit No.1.
Consolidated Edison's decoixtissioning plan, which proposes to nothball the containment building until after the retirenent of Indian Point Unit No. 2, was submitted October 17, 1980 and is presently undergoing our review.
tfith respect to your request for public hearings,10 CFR 50.82 of the Comission's regulatiens pernits authorization of deconnissioning only after the application demonstrates that the dismantling of the facility and disposal of the component parts will be perfomed in accordance with Commission regula-tions and will not be inimical to the conmon defense and security or to the health and safety of the public, and only after notice to interested persons.
Such notice will be published in the Federal Register. The notice would provide an opportunity for persons with an interest affected by the decomis-sioning proposal to request a hearing.
In addition, when the Federal Register notice is published, we util istuc a press release to the local newspapers indicating that an opportunity for a hearing exists. We expect to publish the notice after we complete our review.
