1 PR0CEEDINGS 2

CHAIRMAN ?ALLADINO:

This morning we had discussed D' Y 3 revisions to the Indian Point Order and I understand 4 everybody has had an opportunity to read it.

5 I got one ites from my own staff that says instead 8of "to only accept" to reverse the words and say "only to 7 accept."

8 I would even buy it the way it was.

9 COMMISSIONER BR ADFORD:

I was just going to say, I 10 am grateful to your staff.

The thought had crossed my mind 11 this morning but I did not dare at that point to throw out 12 an amendment.

13 (Laughter.)

0 14 CHAIRMAN PALLADINO:

I think that is the only 15 s 1ggested change.

Would you buy that change and vote "aye" 16for it?

17' COMMISSIONER ROBERTS:

I believe so.

18 COMMISSIONER AHEARNE:

My staff has come up with 19 two questions.

20 (Laughter.)

21 MR. BICKWITs Say it as it is.

22 COMMISSIONER AHEARNE:

That where we say, " focus 23 clearly upon the questions asked by the Commission" we would 24 probably want to go on to say something like, "However, 25 contentions based on allega tions in the UCS petition to h

2 and may ' be considered."

3 CHAIRMAN PALTADINO:

Where are you working from?

,,y U

4 MR. BICKWITs I did not follow you.

5 COMMISSIONER AHEARNE:

It is in the footnote.

6 CHAIRMAN PALLADINot In the footnote.

7 MR. BICKWIT:

Where-abouts?

8 COMMISSIONER AHEARNE:

Well, I wish I could find 9 it.

10 (Laughtar.)

11 COMMISSIONER AREARNE:

The point is that back in 12 the Order when we say, "The Boards focused clearly upon the 13 questions asked by the Commission."

t 14 MR. BICKWIT I anticipted that, and that is why 15 we said in the footnote that it does not make any difference 16whether it is within or outside those questions.

17 COMMISSIO N ER AHEARNE:

So, you feel that 18 clarification is not needed?

19 MR. BICXVIT:

No.

It says, "Without regard to 20 whether they fall within or outside the questions on pages.

21 v..d 10."

22 COMMISSIONER AHEARNE.

The other, which is 23 something that I thouqqt we had agreed to this corning - at

()

24 lea st the wording that I had - was in your phrase, in your 25 Order you say, " Contentions based on," I thought it was O

8 OHAIRdAN PALLADINO:

You want me to co get it?

7 MR. BICKWIT:

All right.

8 COMMISSIONER AHEARNE:

Is that a problem, to say, 9 " Allegatiohs in the UCS petition to the eff ect that certain 10 Ccamission regulations are not met?"

11 MR. BICKWIT:

I do not see any problem with that.

12 CHAIRMAN PALLADINO:

Do you want to see if you can 13 get it?

It should be right on the desk.

14 COMMISSIONER BRADFORD:

Do you see any diffe:ence?

15 MR. BICKWIT:

No.

18 CHAIRMAN PALLADINO:

I do not see much 19 dif ference.

I was reading it right from the document.

20 20MMISSIONER AHEARNE:

This is the old Order.

21 CHAIRMAN PALLADINO:

Yes, that is what I want, the 22 old O rd e r.. I was reading it from, let's see, " Contentions 23 based on the UCS petition to the eff ect tha t certain of our j[)

6 COMMISSIONER AHEARNE:

All right.

7 CHAIRMAN PALLADINO:

Do you have tha t, Sam?

8 MR. CHILK:

Ies, sir.

9 CHAIRMAN PALLADINO:

Any other comments on the 10 Order?

Yay we have s vote to approve it.as modified ?
