i APPENDIX A NOTICE OF-VIOLATIr,
Raytheon Company socket No. 30-04610 Quincy, Massachusetts 02169 License No. 20-01896-03 As a result of the inspection conducted on August 13, 1981, and in accorda.cc with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:
A.
10 CFR 20.201(b) requires that you make such surveys as may be necessary for you to comply with all sections of Part 20. As defined in 10 CFR 20.201(a), " survey" means an evaluation of the radiation hazards incident to the production, use, release, disposal, or presence of radioactive materials or other sources of radiation under a specific set of conditions.
Contrary to this requireme-1, 9; of the day of the inspection, August 13, 1981, you failed +.o make such surveys as were necessary to establish that licensed material 'as not disposed of in a manner other than authorized by 10 CFR 20.361, " Waste Disposal - General Requirement." Specifically, you have failed to assure that nickel-63 foil scraps sent to the normal trash did not contain licensed material.
This is a Severity Level IV Violation.

B.
Condition 14 of your license requires that licensed material be posessed and used in accordance with statements, representations, and procedures contained in application dated May 1, 1976, as amended March 26, 1978 and May 29, 1979.
Your letter dated May 29, 1979 contains a paragraph entitled Nickel-63 Control Procedures.

This paragraph requires that nickel. ribbon be cut to size before irradiation.
Contrary to this requirement, as-of the day of the inspection, August 13, 1981, you have been cutting the nickel-63 ribbon to size as part of your tube assembly procedure which is subsequent ~to irradiation.
2.
This paragraph requires that you perTorm a radiation survey in your facility for nickel-63 at the end of each production week.
j Contrary to this requirement, as of tae day of the inspection, August 13, 1981, no such survey has been conducted.
Further, on_the day of the inspection, August
'3, 1981, you did not possess a survey meter capable of detecting nickel-63.
These are Severity Level IV Violations (Supplement VII).

Pursuant to the !.rovisions of 10 CFR 2.201, Raytheon Company is hereby requir,ed to submit to this office within thirty days of the date of this Notice, a written statement er explalation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violation",; and (3) the date when full cumpliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this repsonse shall be submitted under oath or affirmation. Where good cause is shown, consideration will be given to extending your response time.
The responses directed by this Notice are not subject to the cletrance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
