Administrative Judge and Chairman Atomic Safety and Licensing Board U.S. Nuclear Regulatory Commission Washington, DC 20555 Re: In the Matter of Tenressee Valley Authority (Browns Ferry Nuclear Plant, Units 1, 2, and 3) - Docket Nos. 50-259 OLA, 50-260 OLA, and 50-296 OLA (Low-Level Radioactive Waste Storage Facility)

Dear Mr. Grossman:

It has been three months since the last pleading was filed in this proceeding. Nevertheless, there has been no decision on the out-standing petitions to intervene. Because of the lack of operating license amendments needed for TVA to begin using the low-level radioactive waste (LLRW) storage modules at the site, we may soon run out of approved LLRW storage space at Browns Ferry. Accerdingly, TVA hereby respectfully requests that the Board decide as soon as possible the legal issues regarding intervention which are now pending.

~

In this connection, we believe the recent Appeal Board decision reversing the Licensing Board's decision regarding trans-snipment of spent fuel between the Oconee and the McGuire stations is relevant.

If TVA can assist you in any say, please let us know.

Sincerely, Herbert S. Sanger, Jr.

General Counsel 6"159./yn D303 S
