' Appendix A NOTICE OF-VIOLATION
-Mercy Hospital ~
' License'No. 21-10717-01
-As:a result of the inspection conducted on August 20, 1981, and in accordance-with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified:
1.
Condition No. 16 of your license requires that licensed material be possessed and used in accordance with the statements, representations and procedures contained in certain referenced applications and letters.
The referenced application dated January 25, 1979, states in Item No. 10

that the dose calibrator will be checked uoathly for accuracy of respcase.
Contrary to the above, the dose calibrator has not been checked for accuracy of response from the.date the requirement began on March 21, 1979, to the date of the inspection.
This is a Severity Level V violation (Supplement VII).
2.
10 CFR 35.14(e)(2) requires that leak tests of calibration or reference sources be capable of detecting the presence of 0.005 microcuries of radioactive material on the test sample.
Contrary to the above, the leak test samples of a 204 microcurie Cs-137 source 2eceived in October 1978, had been counted with a side window GM survey meter. This method is not capable of detecting 0.005 microcuries.
Thik is a Severity Level V violation (Supplement VII).
3.
Condition No. 16 of your license requires that licensed material be possessed and used in accordance with the statements, representation and procedures contained in certain referenced applications and letters.
The referenced application dated January 25, 1979, states in Item No. 10.c, that survey instruments will be calibrated at least annually.
Contrary to the above, a Picker CDV-700 G-M survey meter used for daily surveys had not been calibrated from March 21, 1980, to the date of the inspection.
This is a Severity Level V violation'(Supplement VII).

'that film badges will always be worn by persons working in the-Radioisotope Hot Laboratory or with a patient.
Contrary to the above, on August 20, 1981,. the inspectors observed a technologist working in the hot ' laboratory and performing patient in-
. jections without wearing assigned whole body and finger badges.
This is a Severity Lecel V violation (Supplement VII).
