s Appendix A NOTICE OF VIOLATION Alpena General Hospital License No. 21-17754-01 As a result of the inspection conducted on August 21, 1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980),
the following violation was identified:
10 CFR 35.43 requires that when a misadministration involves a diagnostic procedure, the licensee shall notify, in writing, the referring physician and the appropriate NRC Region Office. The reports of diagnostic misad-ministrations are due within 10 days after the end'of the calendar quarters in which they occur. Thest reports shall include the licensee's name; the referring physician's name; a descripcion of the event; the effect on the p ient; and the action taken to prevent recurrence.
Contrary to the above, a diagnostic misadministration which occurred on April 15, 1981, was not reported, in writing, to NRC Region III Office or to the rserring physician as of the day of the inspection.
This is a Severity Level V violation (Supplement VII).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:
(1) cor-rective action taken ad the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as at anded, this response shall be submitted under oath l
or affirmation. Consideration may be given to extending your response time for good cause shown.
