STAFF RESPONSE TO TMIA REQUEST FOR EXTENSION OF TIME L9uise Bradford of TMIA recently delivered a letter (undated) to the Chairman of the Atomic Safety and Licensing Appeal Board Panel in which she requested an extension of time for the filing of exceptions to the August 27, 1981 Partial Initial Decision (PID) in this proceeding. Ms. Bradford cites as a basis for her request the fact that the exceptions to the PID are currently due the same time (September 11,1981) as are comments to the Commission on the immediate effectiveness of the PID.
S'he requests an exten-sion of time to file exceptions until after the oral argument before the Commission on the immediate effectiveness issue.
Because of the conflict presented by the two responses required of the parties referenced by Ms. Bradford, as well as the response to the Licensing Board's August 20, 1981 " Order Relative To The Submission of Views On The Investigation of Cheating," which niust be filed by September 8, 1981, the Staff believes that the Intervenor has shown good cause for its requested extension of time. Moreover, the requested delay should not affect the decision as to the startup of THI-1. The schedules for
2-briefing, arguaent and Connission decision as to the immediate effectivness of the PID, as well as the timing of the appeal, if any, of the more critical final initial decision for the restart proceeding, are unaffected by the requested extension of time.
. Accordingly, the Staff does not oppose an extension of time for the a
filing of exceptions in this case to a specific date immediately following oral arguments on the question of the immediate effectiveness of the PID, t
provided that, if granted, such an extension applies generally to all parties to the proceeding.
