Dear fis. Broner:
This is in response to your recent letter inquiring about the restart of T!!I-1. Unit I was down for refueling at the time of the accident at T!!I-2 in late !! arch 1979. On July 2,1979, the Connission ordered that the facility remain in cold shutdown until further '. 4er of the Commission, stating.that "the Connission presently lacks the Nguisite reasonable assurance that the... Licensee's Three Mile Island Unit fio.1 Facility...can be operated without endangering the health and safety of the public." Further, the Connission stated that public hearings would be conducted to detemine whether TIII-1 should be allowed to resune operation and, if so, under what conditions.
In a subsequent order issued August 9,1979, the Commission established pro-cedures for the hearings and decision on the issues. The hearings began before an flRC Atomic Safety and Licensing Bnrd (ASLB) in Harrisburg, Pennsylvania on Odober 15, 1980.
While we are, of course, concerned about fina:
al.inpacts on consumers and stockholders, the !!RC's prie:ary responsibility is the assurance of public hecith and safety through a fair and th'orough hearing and decision. The record on which the Connission will nake a final decision will include findings and conclusions by the ASLB.

Because of the unique nature of the proceeding and the broad spectrum of issues under discussion, it is Officult to provide a definitive s'chedule for a decision at this time.
The flRC staff is actively involved in the ongoing review of technical issues concerning the restart of Unit I and activities associated with the cleantp of Unit 2.
