Gentlemen:
This will acknowledge receipt of your letter dated July 30, 1981, and your enclosed check in the amount of One Thousand Dollars in full pay-ment of the civil penalties as proposed in the NRC Notice of Violation ana Proposed Imposition of Civil Penalties enclosed with our letter dated June 1, 1981.
\\s Regarding your denial of Items IIB and IIC(l) of the Notice of Violation,

we have carefully considered your appeal and we have determined that the items as stated are items of noncotaliance. The information presented by your appeal does not provide a basis for modificatior, cf this enforce-ment action.
Our basis for this decision is:
(1) your letter stated that you had previously filed an application for an amendment and the NRb Material Licensing Branch did not take prompt action in approving your request l
for amendment.
It should be noted that no use of specifically licensed byproduct material is in accord with NRC regulatory requirements unless and until it is authorized by an NRC License. You also stated that the supervisor was " qualified." This was taken into consideration before enforcement action was taken.
If an individual is qualified but not l
authorized it constitutes noncompliance but a civil penalty is not usually assessed.
If it had been determined that the individual was not qualified it could be the basis for civil penalty action, (2) your letter stated l
you have taken every possible precaution in the training of personnel who care for radiopharmaceutical patients and an " infraction" should not be found simply because one nurse did not comply with hospital procedures.
Nevertheless, the licensee is responsible for the actions of its employees.
Further, failure to wear gloves by one nurse is one of several cases of failure to follow procedures as indicated in our Notice of Violation.
It is management's responsibility to assure that all persc9nel comply with I
license requirements.
