This is in further response to your letter dated April 2,1981, in which you requested, pursuant to the Freedom of Information Act, copies of all documents'preparm' by the NRC staff and/or its consultants relating to the preparation, Jevelopment, and review of SECY-80-491 and SECY-81-84.
The documents listed on Appendix A to this letter are being placed in the NRC Public Document Room,1717 H Street, N.W., Washington, DC.
You may obtain access to these documents by presenting a copy of this letter or by requesting folder F01A-81-131 in your name.
A portion of document 1 and documents 2 through 19 of Appendix B contain information which constitutes advice, opinions and recommendations of the staff. This information is being withheld from public disclosure pursuant to exemption 5 of the Freedom of Information Act (5 U.S.C.
552(b)(5)) and~ 10 CFR 9.5(a)(5) of the Commission's regulations.
The non-exempt portion of document 1 is being placed in the Public Document Room.
The remaining documents contain no reasonably segregable factual information.
Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production I
or disclosure, and that its production or disclosure is contrary to the public interest because its release would tend to inhibit the open and l
frank discussions essential to the deliberative process.
The persons l
responsible for the partial denial of document 1 of Appendix B are the undersigned and Mr. James R. Shea, Director, Office of International Programs.
The person responsible for the denial of document 2 of Appendix B is Mr. Leonard Bickwit, General Counsel.
The person responsible for the denial of documents 3 through 19 is Mr. Samuel J. Chilk, Secretary to the Commission.
The denial by Mr. Shea and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter.
Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in.the letter that l
it is an " Appeal from an Initial F0IA Decision." The denials by Messrs.
j Bickwit and Chilk may be appealed within 30 days to the Commission and j
should be addressed to the Secretary of the Commission.
