We are enclosing for your information a letter sent today to the Chairman of the NRC from Herman Dieckamp, President of General Public Utilities Corporation.
Mr. Dieckamp's letter asks the Commission to reverse the decision reached by the Director of Nuclear Reactor Regulation (NRR) and communicated to Mr. Dieckamp on August 17, 1981, to require reexamination of all of the TMI-l licensed (or candidate) operators who successfully passed the NRC l
written examinations given last April.

Since the Director's decision can be viewed as imposing a new restart requirement which Licensee would be entitled to liti-gate before the Licensing Board, before embarking on the present course of action we considered taking the matter initially to the Board, rather than to the Commission.
The decision to raise the issue directly with the Commission was based upon the following considerations:

NRR intends to administer the licensed operator reexam-inations a'few days in advance of the operator oral exams, which are presently scheduled for September, 1981.
Time is therefore of the essence.
Direct review of the NRR decision by the Commission appears to be the only practicable course of action available to us.

We believe the Commission can make a decision on the matter based on the several factual investigations conducted by the l
Staff without the development of a further evidentiary record by the Licensing Board.
In fact, Mr. Dieckamp's letter to the Commis-sioners does not take issue with the factual findings reached in the investigative reports issued by the Office of Inspection and Enforce-ment and by the Office of Inspector and Auditor but, rather, bases its objections upon them.

Finally, we have taken into account the Staff's handling i
of the reexamination issue, which so far as the Board is concerned consisted of informing the Board of the investigative efforts under-way, the results of the investigations, and NRR's proposed action.
The Staff sought no action by the Board.
Clearly, the Staff was of the view that the reexamination issue is severable from the restart hearing; in fact, Mr. Denton indicated to Mr. Dieckamp that he felt at liberty to and did discuss the matter with Chairman Palladino prior to making his decision.
In summary, we are forwarding the attached letter to you in order to keep you fully apprised of a matter pending before the Com-mission which could bear on the restart of TMI-1.
