Dear Mr. Helfrich:

Enclosed please find'an application from the Delegation of the Commission of European Communities for a license to export three NBS standards containing a tetal of 3 grams of uranium to the Finnigan MAT Company in West Germany.

Finnigan MAT will use the standards as part of its maintenance program for mass spectrometers which it sells world wide.

In this regard, the Delegation is also requesting authorization for Finnigan MAT to temporarily retransfer these NBS standards from West Germany to various countries where the mass spectrometers are located in order to test and calibrate the insi.ruments. The Company presently has these instruments in Japan, Australia, Austria, Switzer-land, Sweden, Canada, Norway, Denmark, Finland, Taiwan, PRC, Brazil, Argentina, South Africa, South Korea, India, Mexico, Spain, Portugal, Egypt, Saudi Arabia, Israel, Pakistan, Indonesia, Algeria, Libya, Turkey, Nigeria, Yugoslavia, and Venezuela. The NBS standards will always be returned to Finnigan MAT. The Celegation is aware that not all of these countries may meet the U.S. export licensing criteria.

Because Executive Branch review is not required with respect to several of the countries involved, NRC will be issuing a license to the Delegation authorizing the export of the standsrds to West Germany for subsequent reexport to the following countries: Japan, Australia, Austria, Switzerland, Sweden, Canada, Norway, Denmark, and Finland.

Before NRC adds the remaining countries to the license (Taiwan, PRC, Brazil, Argentina, South Africa, South Korea, India, Mexico, Spain, Portugal, Egypt, Saudi Arat'ia, Israel, Pakistan, Indonesia, Algeria, Libya, Turkey, Nigeria, Yugoslavia, Venezuela), we would appreciate the views of the Executive Branch in accordance with established procedures as to whether the proposed reexports meet the applicable criteria in the Atomic Energy Act as amended by the Nuclear Non-Proliferetion Act of 1978, particularly with respect to Pakistan, Israel, ar.d India.
