JJoyner, R0:I We have reviewed your Fundamental Nuclear Material Control (FHMC) Plan of Jane 11, 1980 together with subsequent revisions received by letters dated August 27, 1980 and llarch 25, April 17, and June 2,1981, respectively.

Based upon our review of your revised plan and extended discussions concluded on June 12,1981 a a telephone conversation between Mr. T. Bowie of CE-Windsor and Mr. R. L. Jackson of my staff, we have detenained that your current FHMC Plan is acceptable in accordance with 10 CFR 70.32(c).

Accordingly, we are revising License Condition 2.1 of Materials and Plant l

Protection Amendment !!PP-4 (Sections 1.0 through 8.0 only) to your License No. SNH-1067, effective imediately, as shown in the enclosure. The enclosure l

also reflects the deletion, as well as the necessary retention, of License Conditions found in your current MPP-4.

We have detenained that the attachments to the previously stated letters contain information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.79:'f d)(1), such information is deemed to be comercial or financial inforiaation within the meaning of 10 CFR 9.S(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.

Currently no license conditions under this section. The appropriate requirements have been incorporated into the approved plan.

2.0 FACILITY OPERATION 2.1 The licensee shall follow the Fundamental Nuclear Material Control Plan pages marked respectively as:

Revision 2 - August 1979 Revision 3 - February 1980 including Appendix A-12 to A-14 submitted with the original FNMC Plan application of January 1975 Revision 4 - August 1980 Revision 4 - March 1981 Revision 1 - April 1981 (Appendix A-2 & A-2.1)

Revision 4 - April 1981 and the undated Appendices submitted with the letter of June 11, 1980 and as revised in accordance with the provisions of 10 CFR 70.32(c).

2.2 No statement in the licensee's Plan identified in Condition 2.1 shall relieve the licensee of a requirement of 10 CFR Part 70 unless granted in a specific exemption or exception set forth as a condition of this license.

2.3 The Plan identified in Condition 2.1 is applicable only to low enriched uranium. Prior to the receipt and processing of highly enriched uranium in unsealed form, a plan for that material shall be submitted by the r

licensee and be approved by the NRC.

3.0 MEASUREMENTS l

Currently no license conditions under this section. 'The appropriate requirements have been incorporated into the approved plan.

4.0 MEASUREMENT CONTROL 4.1 In lieu of Procedures 4.2.2.1 found in the FNMC Plan, Page 4.7 l

4.2 Notwithstanding the requirements of 10 NR 70.57(b)(ll) to use Control Charts to monitor the quality of each program measurement and to use the.001 level of significance for control of scales, I

the licensee shall follow Section 4.5.1 of the Plan identified in Condition 2.1.

4.3 Notwithstanding the requirements of 10 CFR 70.57(b)(4) to provide sampling syste:natic errors, the licensee shall follow Section 4.2.4.2 of the Plan identified in Condition 2.1.

4.4 Notwithstanding the requirements of 10 CFR 70.57(b)(8) and (10) to i

not provide de minimis quantities for bias calculations, bias corrections, and systematic errors, the licensee shall follow i

Section 4.2.4 of the Plan identified in Condition 2.1.

i 4.5 Notwithstanding the requirements of 10 CrR 70.57(b)(8), the licensee may (1) obtain random and systematic error data for volume from l

calibration data, (2) combine random analytical and random sampling errors, and (3) generate random error data for bulk and NDA from the j

measurement of standards.

4.6 Notwithstanding the requirement of 10 CFR 70.57(b)(ll) to estsblish and maintain control limits at the.05 and.001 significance levels l

for accountability neasurements, the licensee may allow their present contractor laboratory to continue the practice of using the NBL or 1

NBS standards certified tolerance limits for measurement systems control.

5.0 INVENTORY Currently no license conditions under this section. The appropriate i

requirements have been incorporated into the approved plan.

7.1 The same individual shall not sign a document as both tFe shipper and receiver for transfer between MBA's.

7.2 Accurate records shall be established and maintained en a bi-weekly basis for low enriched uranium to provide knowledge of the identity, location, and quantity of all SNM within each plant in discrete items j

and containers.

8.0 MANAGEMENT Currently no license conditions under this section. The appropriate j
