August 18, 1981 MEMORANDUM During the evidentiary hearing session on August 13, 1981,- the Board approved 3 hearing schedule under which the seismic criteria for the Midiland site are to be considered beginning October. 13, 1981 (Tr. 4335).

Prepared testimony is to be. filed at least two weeks earlier--i.e_., by September 29, 1981 (Tr. 4336).

It ir our understanding that the Appficant will elect one of the two alternatives for selection of the Safe Shutdown Earthquake-(SSE) and I

associated ground acceleration suggested in the letter dated October 14, 1980 from Robert L.- Tedesco (NRC) to J. W. Cook of Consumers Power Co.,

titled " Seismological Inp;t for the Midland Site." The first alternative is

= apparently based on a deterministic aoplication of 10 CFR Part 100, Appendix

'A (utilizing the standardized response spectra of Regulatory Guide 1.60 anchored'at 0.19 ).

The second appears to be a probabilistic approach which 9

3 utilizes' site specific response spectra.

li. the Applica'nt should elect to rely:upon the site specific response spectra approach, we request that both the Applicant and Staff file trial

. briefs discussing the compatibility of thi's approach with the requirements 1'E sof 10 CFR Part.100, Appendix A.

See, in particular, paragraphs V(a)(1)(ii) and (iv) of Appendix A.

The Staff's brief should, inter alia, provide information concerning the Commission's approval of or other action, if any, with respect to the site spccific response spectra approach.

Parties-other than the Applicant and Staff are invited to file such briefs, if they wish to do so. All such briefs should be filed no later than the time for filing

-prepared testimony concerning the SSE issue.
