MODIFICATION OF FEBRUARY 11, 1981 ORDER 1
I.
In an Order to Modify License ("the Order"), 46 Fed. Reg.12566 l1 (Febrt ry 17, 1981), the duclear Regulatory Commission directed Westinghouse Electric Corporation ("the licensee") with facilities in Columbia, South l
Carolina, to submit within 180 days of the effective date of the Order either i

incorporate the plan as a condition of the license or, alt arnatively, to l
submit an application for license 6.aendment to reduce the possession limits

for radioactive materials below specified quantities.
By letters dated June 18 and juiy 16, 1981, the licensee requested additional time in which to prepare and submit a radiological contingency I
- plan.
In its July 16 letter, 'he licensee indicated that a 30 day extension 1
beyond August 31 would be sufficient.
The licensee's reasons for the requested extension were that. additional time was necessary to complete preparation of f
tb plan.
l The licensee should upgrade its existing emergency plan to conform to the guidance contained in Enclosure 1 to the Order at an early date.

requested extension shoula not affect the licensee's emergency preparedness because the licensee has, as an existing condition of its license, an emergency plan which addresses many of the elements of the radiological contingency plan required by the Order.
Since the licensee's request is reasonable under the circumstances, the Director has determined that there is good cause for modifying the Order and granting an additional 30 days to submit the revised plan.
II.
Accordingly, pursuant to sections 53 and 161b of the Atomic Energy Act of 1954, as amended, 9570.32(a)(8), and 70.32(b)(2) of 10 CFR Part 70, and
$2.204 of 10 CFR Part 2, IT IS HEREBY ORDERED that the time within which the licensee shall submit a radiological contingency plan, pursuant to the Order dated February 11, 1981, shall be extended to September 30, 1981.

i except as modified herein, remains in effect in accordance with its terms.
III.
The licensee or any other person who has an interest affected by this Modification of Order may request a hearing on this Modification of Order within 25 days of its issuance.
A request for hearing shall be submitted to the Director, Division of Fuel Cycle and Material Safety, U.S. Nuclear Regulatory Commission, Washington, D.C., 20555.
Copies of the request shall also be sent to the Secretary of the Commission and the Executive Legal Director a', the same address.
If a hearing is requested by a person other J

than the licensee, that person shall describe, in accordance with 10 CFR 2.714(a)(2), the nature of the person's interest and the manner in which that interest is af' c'ed by this Modification of Order.
If a hearing is requested by the licensee or other person who has an interest affected by this Modification of Order, the Commission will issue an order designating the time and place of any such hearing.
If a hearing is held, the issue to be consic:ered at such a hearing shall be whether this Modification of Order should be sustainea.
This Modification of Order shall become effective upon expiration of the period within which a hearing may be requested or, if a hearing is requested, on the date spacified in an order issued following further proceedings on this i
