MEliORANDUM AND ORDER ON PREHEARING CONFERENCE This Order relates to additional agreements and decisions made during the prehearing conference conducted under 10 CFR 2.752 at Wilkes-Barre, Pennsylvania on August 12, 1981.

Contentions 3 15 - 18 are withdrawn from the proceeding and the Board and the parties will be advised in the near future whether Ccntention 1 is withdrawn.
It was recognized that Contention 19 was withdrawn at a prior session of the prehearing conference.
Inasmuch as intervenor liarsh et al was not represented, although directed to be present, at the conference and only participated in a part of its

previous sessions, the Board directs it be advised within a ten day
~
period beginning with receipt of service of this Order whether intervenor Dso) desires to have its remaining Contentions litigated'.
Specifically, this 3

Requirements and obligations for th,e hearing:
{
(a) The qualifications, identities, subject matter and substance of testimony of expert witnesses shall be filed forty (40) days (August 25, 1981) prior to the hearing's commencement on the first seven contentions to be heard. Written testimony, and any exhibits, in connection with these contentions must be filed, at least, twenty-ov (21) days before the hearing's commencement, which as announced is October 6, 1981. The material and submissions referred to shall be submitted on the remaining contentions within a two week period after the above dates - September 8 and September 29 respectively.-
(b) Cross examination plans shall be submitted to members,
j of the Board alone at least three days nrior to the beginning of the October 6 hearing date on the fitst seven contentions and within a three week period thereafter on the remaining contentions.
In no event should these plans be submitted after a hearing session commences on the contention to which it relates.
(c) Motions for summary disposition are currently pending a decision by the Board on three or LSe first seven contentions to be heard.
In the event these motions are approved, the contentions affected will be deleted from the above schedule requirements and none of the remaining contentions will be substituted in their place.
