e Revised Appendix A NOTICE OF VIOLATION Fort Hamilton-Hughes Memorial License No. 34-02091-05 Hospital Center EA 81-19 As a result of the investigation conducted on September 30 - October 3, 1980, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified.

License Condition 23 of NRC Byproduct Material License No. 34-02091-05 requires the licensee to possess and use licensed material in accordance with statements, representations and procedures contained in, among other referenced letters, a letter with enclosures dated July 11, 1977. An enclosure to this letter, relating to emergency procedures, states that in the event of an equipment failure resulting in the source remaining "0N," the patient should be removed from the treatment room, the treatment room door should be locked and the responsible physician and the Radiation Protection Officer should be notified.

Contrary to the above, on the afternoon of September 25, 1980, when the licensee's teletherapy source stuck in the "0N" position, the technician who was operating the teletherapy unit did not respond to a Prime Alert radiation monitor that showed the teletherapy source was in the "0N" position and failed to initiate required emergency procedures. The technician entered the treatment room after the conclusion of a patient treatment and was in the room approximately 1 - 1/2 minutes before a second technician entered the room, realized that an emergency condition existed, and finally initiated emergency procedures.

This is a Severity Level IV violation (Supplement VII).
