i Appendix A NOTICE OF VIOLATION Department of the Army Madigan Army Medical Center Tacoma, Washington 94831 License No. 46-02645-03 As a result of the inspection conducted on July'23,1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October -7,1980),
the following violations were identified:
A.
License Condition 15. A(l') requires that' each sealed source contain-ing licensed material, other. than hydrogen-3, with.a half life greater than thirty days, and'in any form othert than gas, shall be tested for leakage and/or contamination at ' intervals.not to exceed six months.
Contrary to the above requirements, the 100 millicurie ' strontium-90 source was leak tested on June 15,1979,' and was not leak tested again until January 24, 1980, a period of seven months. Also, the source was leak tested on October 2, 1980, and the leak test was not repeated again until May 6,1981, a period of seven months.
This is a Severity Level IV Violation (Supplement VII)
B.
License Condition 16, in part, states that the licensee shall possess and use licensed material in accordance with statements, representations, and procedures contained in application dated April 19, 1979.
Item 17 of the application dated April 19, 1979 states that area surveys are to be conducted in accordance with the procedures outlined in Appendix I of the Medical License. Guide
.(Regulatory Guide 10.8) issued January 1979. Appendix I of the guide states that weekly radiation 'and contamination surveys are to be made and records of the surveys to be maintained.
Contrary to this requirement, at the time. of the inspection, records

of weekly surveys conducted during April, May, July, August, October, December of 1980, and January-March,1981, were not maintained.

10 CFR 20.401(a)(3) requires that records of disposal of -licensed material made pursuant to 10 CFR 20.203(d) are to be maintained until the Commission authorizes their disposition.
. Contrary to the above requirement, at the time of the inspection, records-of radioactive liquid waste disposal into the sanitary I
sewer made by the Nuclear Medicine Laboratory were not maintained I
for the periods of July 18, 1978 through May, 1980 and August.

10 CFR 35.14(b)(5)( ) requires a. quarterly physical inventory be conducted to account for all sources and devices received and possessed. Records.of the inventories shall be maintained for inspection by the Commission and shall include the quantities and kinds of byproduct materials, loc ~ation of sources and devices, and the date.of the inventory.

Pursuant to the provisions of 10 CFR 2.201, Madigan Army Medical Center is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items 'of noncompliance; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown. The responses directed by this notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork _ Reduction Act of 1980, PL 96-511. Under the authority of section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath an affirmation.
