r Appendix A NOTICE OF VIOLATION Diamond Shamrock Corporation License.No. 34-00583-04 As a result of the inspection conducted on July 22, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

Condition 8.A of your license limits the amount of carbon-14 that you may possess at any one time to a total of 400 millicuries.

Contrary to this requirement, you possessed more than 400 millicuries of carbon-14 at one time. Specifically, your February 2, 1981 inventory showed a balance of 512 millicuries of carbon-14 in your possession.

This is a Severity Level V violation (Supplement VII).

2.

Condition 14 of your license requires that you test your sealed sources containing licensed material for leakage and/or contamination at intervals not to exceed six months.

Contrary to this requirement, sealed sources were not leak tested every six months. Specifically, the americium-241, cadmium-109 and iron-55 sources currently -in an ORTEC Source E citer X-ray Flourescene Analyzer were not leak tested between August 15, 1979 and March 20, 1981.

This is a Severity Level V violation (Supplement VII).

License Condition No. 20 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in vcrious dated applications and letters.

The application dated March 28, 1978, item No. 11, states that the Nuclear Chicago survey meter (Model 2650) will be calibrated every six months.

Contrary to the above requirement, your Nuclear Chicago survey meter (Model 2650 - Serial No. 3837M) was not calibrated between September 1978 and December 1980, and between December 1980 and July 1981.

These periods are in excess of the six month requirement.

Appendix A Pursuant to the provisions of 10 CFR 2.201, y u are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) time date when full compliance will be achieved..Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
