App,endix A NOTICE OF VIOLATION Mercy Hospital License No. 34-15682-01 As a result of the inspection conducted on July 16, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

License Condition No.16 states that the dose calibrator shall be calibrated in accordance with the procedure described in Appendix D, i

Section 2, NUREG-0338, Revision 1, dated November 1, 1977. That procedure requires daily constancy, quarterly linearity and annual accuracy checks be performed of the dose calibrator.

Contrary to the above requirements, dose calibrator daily constancy, quarterly linearity anc*. annual accuracy checks have not been per-formed as described in Appendix D since inception of this requirement.

This is a Severity Level V violation (Supplement VII).

License Condition No. 17 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in the application received July 17, 1978 and the letter dated November 14, 1978.

Item No. 10 of the above referenced application requires annual calibration of survey meters.

Contrary to this requirement, your Victoreen Model 740-F and Picker Model 25-5574 survey meters have not been calibrated since the date of license issuance, a period in excess of one year.

This is a Severity Level V violation (Supplement VII).

License Condition No. 17 requires that licensed material be possessed I

and used in accordance with statements, representations and procedures contained in the application received July 17, 1978 and the letter l

dated November 14, 1978.

Item 14 of the application states that incoming packages containing radioactive material will be monitored l

at the surface and at three feet and wipe tested for external con-tamination.

Contrary to the above, the requirements for monitoring and wipe testing all incoming packages has not been met since inception of this requirement.

This is a Severity Level V Violation (Supplement VII).

Item No. 17 of the above referenced application. states that specific areas will be surveyed daily and other laboratory areas will be surveyed weekly. The weekly surveys will include wipe tests to measure contamination levels using a method sufficiently sensitive-to detect 100 dpm.

Contrary to the above, daily and weekly area surveys have not been performed and your method of analyzing wipe tests is not'sufficiently sensitive to detect 100 dpm. Specifically,_ daily and weekly area surveys have not been performed since the date of license issuance and wipe tests have been analyzed using a portable GM coc3(er which is incapable of detecting contamination levels as low as 100 dpm.

This is a Severity Level V violation (Supplenent VII).

Pursuant to the provi. cions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action'to be taken to avoid further noncompliance; and (3) the date when 4

full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to-extending your response time for good cause shown.
