Honolulu, Hawaii 96816 l

As a result of the inspection conducted on May 11, 1981, and in accordance _

with the Interim Enforcement Policy 45 FR 66754 (October 7,1980), the following violations were identified:

A.

10 CFR 71.12(b)(1) requires persons utilizing a general license pursuant to 71.12 for shipment of a package for which a certificate of compliance has been issued by the Comission's Director of Nuclear Material Safety i

and Safeguards, to have a copy of the specific license, certificate t

of compliance, or other approval authorizing use of the package.

I Contrary to the above, at the time of the inspection, no certificate of compliance, specific license, or other approval was maintained for a Gama Industries Model Century exposure device which contained a 100 Ci Ir-192 sowce, No. 99.070. This model century exposure device j

was sent from Finlay Testing Laboratories to a temporary job site on j

Maui on December 10, 1980, by Air Cargo Express.

This is a Severity Level VI Violation (Supplement VII).

10 CFR 20.408(b) specifies that when an individual terminates employment with a licensee described in 10 CFR 20.408(a), which includes radiography licensees, or an individual assigned to work in such a licensee's facility but not ecployed by the licensee, completes the work assigned in the j

licensee's facility, the licensee shall furnish to the Director of Management and Program Analysis, U. S. Nuclear Regulatory Commission, i

l a report of the individual's exposures to radiation incurred during employment or work assignment at the licensee's facility (a,)containing i

i infomation recorded by the licensee pursuant to 20.401 Such a l

report shall be furnished within 90 days after the date of termination i

of employment or work assignment whichever is earlier.

I Contrary to the above requirement, a radiographer was teminated on 1

October 15, 1980, and at the time of the inspection no termination report had been provided to the Director of Management and Program Analysis.

This is a Severity Level VI Violation (Supplement VII).

10 CFR 71.51 requires licansees to establish, maintain and execute a quality assurance program satisfying each of the applicable criteria specified in Appendix E " Quality Assurance Criteria for Shipping Packages of Radioactive Materials." The licensee is required to furnish a description i

l Appendix A i of the quality assurance program to the Director of the Office of fluclear i

Material SaWty and Safeguards. The licensee's quality assurance program submittal was approved in August of 1979. The licensee's quality assurance I

program specifies in Section 7.1 that, "A quarterly audit of the quality assurance program will be perfomed."

Contrary to the above requirement, an audit of the quality assurance l

progran for packaging of radioactive material had not been performed between July 10, 1980, and the date of the inspection.

Pursuant to the provisions of 10 CFR 2.201, the Finlay Testing Laboratory, Honolulu, llawaii, is hereby required to submit to this office within thirty days of the date of this notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further itens l

of noncompliance; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.

The responses directed by this Motice are not subject to the clearance procedures of the Office of Management and Budget as required by the Papemork Reduction Act of 1980, PL 96-511.
