ORDER TERMINATING PROCEEDING

On June 12, 1979, the Commission issued an order in the above-captioned proceeding requiring the Florida Power & Light l
Company (FPEL) to respond through an answer showing cause, if any there be, why the Commission should not find and conclude that FPGL has violated its existing tariff and the Federal Power Act by having refused.to provide service to the Fort Pierce Utilities Authority (FPUA).
In light of our decision in Florida Power & Light Ccmpany,

Opinion No. 57, August 3, 1979, we conclude that the issues raised by FPUA in this proceeding have been resolved.
- Indeed, in the application for rehearing of Opinion No. 57, FPSL has now informed us that it no longer contests-FPUA's right to service under its tariff. -*/
Thus, the issues raised by FPUA in its complaint have been resolved and, accordingly, we shall terminate this proceeding.
The Commission orders:
This complaint proceeding, initiated by order issued January 24, 1978, is hereby terminated.
