't[Qincoming This is in response to that portion of your letter of ifay 1S,1981 to T1 Secretary J. D. Edwards of the Depart"ent of Energy dealing with delays in restart of T!!I-1.
Unit 1 is shutdown in accordance with an Order of July 2,1979, by the Nuclear Regulatory Commission, which stated:
"In view of the variety of issues raised by the accident at the Three flile Island Unit flo. 2 facility, the Comission presently lacks the requisite reasonable assurance that the same licensee's Three flile Island Unit flo.1 facility, a nuclear power reactor of similar design, can be operated without endangering the health and safety of the public.
Accordingly, we direct that the Unit No.1 facility, presently in a shutdorm condition, shall reoain shutdown until further order of the Comission itself. The Comission has further determined that it is in the public interest that a hearing precede restart of the facility."
The Comission's Order of August 9,1979 specified the basis for its concerns and defined procedures to govern further proceedings in this riatter (Attachment 1).
The Conmission issued a March 23, 1981 Order which included a discussion of various reans of expediting the Tf11-1 restart proceeding (Attachnent 2).
In that Order, the Comission reversed the position taken in its August 9,1979 Order regarding the need to litigate the licensee's financial qualifications, and renoved the financial qualification issue from the proceeding. The March 23 Order also stated that the licensee would be permitted to begin hot functional testing of TMI-l systens and equiprent using non-nuclear heat, subject to appropriate staff review, and that the Commission would issue its decision on the effectiveness *of the ASLB's decision within 35 days after the issuance of the TMI-1 Ifcensing board decision.
The hearing record was closed on July 9,1981. Based on appropriate time spans for subsequent actions in connection with the hearing (proposed findings, initial decision, Comission decision), the Comission decision on restart can be exnected around October of this year. The licensees schedule for f
completion of rodifications recomended by the NRC staff as required for j
i restart is llovember,1981.
