Pursuant to $103 of the Atenic Energy Act of 1954, as acceded (the Act), and Title 10, Chapter 1, Ccde of Federal Regulaticas, Part 50, " Licensing, of Prcductica and Utilisation Facilities,"
and pursuant to the Initial Decision of che Atonic Safety and Licensing Board, the Accate Energy Cc==ission (the Cc-f nsion) hereby issues a construction per=it to the Alaba=a Powar Cc rpany (the applicent) for a utill:2 tion facility (the facility),
designed to operate at 2652 ne;2' atts (thernal) described in the application and a=end=2nts thereto (the application) filed in this natter by the aoplicant and as nore fully cascribed in the evidence received at the public hearing upon that-application. The facility, kncra as the Joseph M. Farley Nuclear Plant, Unit 1, vill be located in Housten County, Alaban2, about 15 =iles ncrth of Jackron County, Florids, and across the river fron Early County, Georgia.

Pursuant to 5105c(8) of the Act, the Cc==ission has consulted with the. Attorney General regarding the issuance of this c' ens tructica per=1t.

'Ihe Cc=nission, accordingly, has made no determination with respect to matters covered in $105c. of the Act including canditions, if any,
which may be appropriate as a.isult of the outco=,e of the antitrust proceeding.
On the basis of its findings made as a result of such antitrust proceeding * -
the Co::=tission may centinue this permit as issued, rescind this permit or amend thLi permit to include

such conditions as the Cc= mission deems appropriate'.
This construction permit therefore shall be subject to the outco=e' of an antitrust proceeding to be held pursuant to a notice of hearing dated June 28,1972, for the purpose of deternining "whether the activities under the permit [s] in question would create or maintain a situatica inconsistent with the antitrust laws."
Applicant and others who may be affected hereby are on notice that the granting of this permit is without prejudice to any subsequent licensing acticn, including the imposition of appropriate conditions,* which cay be taken by the Co=aission as a result of the outcome of this antitrust proceeding.
In the course of its planning
