Dear Judge Bowers:

On June 26, 1981, the Pcwer Authority of the State of New York filed a motion to discontinue the proceeding in-dicated above. Copies of this motion were served on the parties to the proceeding on June 26,.1981. At that time, l

the Authority indicated that all parties to the proceeding but two had indicated that they do not object to the Auth-l ority's motion. Since that date, the Authority has learned

~

that one of the two outstanding parties, George V. Begany, Mayor of the Village of Buchanan, has no objection to the motion. The Authority understands that Mr. Begany will be submitting a letter setting forth his views. The remaining party, National Resources Defense Council, has expressed no opinion to date concerning the motion.

l.

Pursuant to 10 C.F.R. S 2.730 (c) answers to the motion must be served within 15 days of service of a motion by mail unless the time limit is extended. The deadline for respon-l ding to the motion was July 13, 1981 and the Authority is not aware that any such extension has been granted. Since no answers have been filed in response to the Authority's motion, the Authority believes that no party objects to the

granting of the motion. gC3 S
