Little July 27, 1981 Page Two In the Commonwealth of Pennsylvania's proposed findings of fact (Second Set, June 12, 1981) on UCS Contention No. 14, the Commonwealth asks the Board to direct Licensee, prior to exceeding 5% power, to upgrade the pressurizer level instrumentation power supplies "such that power can be supplied from redundant vital power supplies" and " failure of the ICS/NNI power supply would not cause a loss of all pressurizer level instruments." PA PF 234.

When the Commonwealth questioned Mr. Keaten in November, 1980, he was aware, as the Commonwealth notes, that a change was under development; but he could not speak to the details or the schedule.

While it is not a matter of evidence, Licensee has advised me that it is modifying the power supplies to the pressurizer level instrumentation as proposed by the Commonwealth, including the proposed schedule. While we do not believe such a change is required for safety (or "necessary" within the meaning of the Commission's Order and Notice of Hearing) , the modification is being undertaken as a part of the overall ICS/NNI power supply upgrade in response to the Crystal River-3 transient. Consequently, so that the Board need not address academic issues (i.e., the timing, rele vance , and " necessity" of the Commonwealth's proposal) , Licensee consents by virtue of these reply findings to the relief requested in Commonwealth proposed finding 234.
