SAFETY EVALUATION REPORT TENNESSEE VALLEY AUTHORITY (TVA)
APPLICATION DATED JANUARY 23, 1981, AND SUPPLEMENT THERET0 DATED JUNE 8, 1981 FOR A STORAGE LICENSE FOR FUEL FOR THE

BELLEFONTE' NUCLEAR PLANT, UNIT 2 DOCKET 70-2941
'The-subject application requests a license to receive 4,500 kilograms of U-235
- contained in uranium enriched to 3.50 wt percent, in the form of 270 fuel assembl_ies and 100 loose rods.
The license application describes fuel and storage-conditions that are similar to those for Bellefcnte Nuclear Plant
- Unit 1,;for which storage of fuel in the new fuel vault is authorized in existing license SNM-1865,' issued January 30, 1980.
Units 1 and 2 use the
'same vault for new fuel, where assemblies.are stored dry on 21 inch centers, but-the units _have separate spent fuel pools..The spent fuel pool for Unit 1 was not completed when SNM-1865 was issued and thus the requested authorization to receive 270' assemblies at Unit 2 includes 65 assemblies for Unit 1.
The
' application'for Unit 2 covers storage in either the new fuel racks (common to both units) or the spent fuel pool for Unit 2.
The nuclear criticality safety of the new fuel racks is covered by the safety evaluation reporti issued when the storage license was issued for Bellefonte Unit 1.

Fuel will.be stored dry in thel spent fuel racks.- Uranium enriched to 3.5% in
-the' U-235' isotope cannot be made critical unless a moderator such as water is
-present.- TVA has provided a criticality safety analysis to demonstrate that the spent. fuel racks will remain subcritical fully flooded or at credible clower. levels of moderation. The calculations provided by TVA were confirmed

by independent. calculations by the NRC Staff using the SCALE program with the i
123 group cross section set.
Conservative calculations by the Staff have shown that two or more of these fuel assemblies or 300 fuel rods are required in order to attain criticality.
TVA has: established controls to assure that no more than one fuel assembly and 30' fuel rods-may be out of approved shipping containers or storage locations aF any one : time.
In addition, TVA has-stated that plastic fuel assembly covers will be open at the bottom-to allow for free draining of water in the L
event of flooding and subsequent draining of a storage area.
Hence, it is the Staff's-judgment that TVA has established satisfactory precautions to avoid accidental criticality.
The Staff has reviewed the applicant's physical protection program for low enriched uranium fuel:and found it in accordance with the provisions of 10 CFR 73.67.
The applicant has also described the basic aspects of the radiation safety control program, including a description of the training and experience of the
- personnel responsible for administering the program., The Staff has concluded h,

2 JUL 8 1981 that the applicant's radiation safety program and personnel are adequate to allow.them safely to carry out the activities for which a license is requested.
The applicant hcs requested, pursuant to 10 CFR 70.24(d), an exemption from the provisions of 10 CFR 70.24.
Based on the applicant's demonstration of subcriticality under normal and accident conditions, good cause exists for eremption from the requirements of 10 CFR 70.24. Because of the inherent fs.atures associated with the storage and inspection of unirradiated fuel containing uranium enriched to less than 5% in the U-235 isotope when no fuel processing activities are to be performed, the Staff hereby determines that
. granting such an exemption will not endanger life or property or the common defense and security, and is in the public interest.
This exemption is authorized pursuant to 10 CFR 70.14.
The NRR Project Manager, Mr. R. Hernan, and the Resident' Inspector, Mr. J. Wilcox,
~have stated that they have no objection to issuance of the license.
CONCLUSION Based on the facts summarized in the foregoing paragraphs, the Staff believes that the proposed activities can be performed without undue risk to the health and safety of the public.
It has been determined by the Staff that the applica-tion fulfills the requirements of 10 CFR 70.23(a).
Further, the issuance of this licerse is not a major federal action significantly affecting the quality of the human environment and thus, pursuant to 10 CFR 51.5(a)(4), no environ-mental impact statement, negative declaration, or environmental appraisal need be jrepared.
RECOMMENDATION The Staff recommends approval of the application and of the exemption of the licensee from the requirements of 10 CFR 70.24.
