In your letter of July 4,1961, you inquired as to whether your "uimeographed inputs" would be considered by the iluclear Regulatory Commission in the event that Westingnouse Electric Corporation should apply, in the future, for a special nuclear naterial license for the AHFFP facility.
It is the understanding of the NRC Staff that Westinghouse Electric Corpora-tion intends to file a notion to disaiss the present proceeding after the pending request to withdraw its application has been granted.
In the event i
that Westinghouse should decide to apply for an SHil license for the ANFFP l
facility after the present proceeding nas been dismissed, a notice of oppor-tunity _for hearing would have to be filed and a new proceeding would be instituted upon the filing of a proper petition for leave to intervene.
Docu-ments which had been filed in a price proceeding -- such as your nireographed materials -- would not automatically becone part of the record in such a newly instituted proceeding, but would have to be re-filed.
