(Closing Discovery)
On June 1,1981, NIPSCO moved the Board to establish a schedule closing discovery on July 31,1981 (by which date final responses to discovery would be filed), requiring the filing of testimony by August 31, 1981, and beginning the hearing on September 15, 1981. Staff supported the motion and the particular scheduling dates proposed; PCCIs and the State of Illinois opposer, any scheduling until the Staff has completed its evaluations of whether good cause exists for the construction completion date extension and whether an environmental impact statement should be prepared.
Upon consideration of th.e fa_ cts.and arguments contained in the submittals, it is this 10th day of July 1981 Ordered That all new discovery be initiated by July 31, 1981; That all depositions be scheduled by August.28,1981; b

2-That all responses to discovery be updated by August 31, 1981; i
That all contested discovery to the extent that it cannot be completed by August 31, 1981, will be scheduled beyond that date by Board order; That discovery necessitated by further Board action on pending contentions or the issuance of further Staff evaluations or reports will be scheduled only by Board order on application by a party within twenty days after service of the Board action or Staff issuance or thereafter upon good cause shown; and That the portion of NIPSCO's motion requesting a scheduling of the prefiled testimony and hearing is denied pending the issuance of the Staff evaluations.
