This refers to your letter dated June 19, 1981, in response to our letter dated May 20, 1981.

Thank you for informing us of the corrective and preventive actions docur.ented in your letter. As you know, you took these same actions to satisfy the Pegion I Immediate Action Letter to you, dated Oc:ober 1,1980, concerning csckaging and shipment of radioactive waste for burial. The status of the completion of these actions was inspected during inspection No. 70-820/81-03 on March 2-4, 1981. As indicated to you in the Region I letter of March 19, 1981 concerning this inspection, our inspector verified that you essentially had cc:apleted the actions by implementing your licensed Quality Assurance Program for Preparation and Shipping of LSA Radioactive Materials.

In those areas where practices had to be improved to meet the proqram, you indicated that this would be accomplished. These improved practices will be examined during a future inspection of your licensed program.

In regard to your response to item of noncompliance C.2, you should note that although the exact condition of the material in the containers at the time it was offered to the carrier for transport cannot be known, it is known that some of the waste was in a ' liquid state sometime during transit from Wood River Junction, Rhode Island, to Beatty, Nevada, since it leaked from the container.

Therefore, the matter is properly classified as a violation.
