BARTON NUCLEAR PLANT, UNITS 1, 2, 3 AND 4 NOTICE OF WITHDRAWAL OF APPLICATION FOR CONSTRUCTION PERMITS By letter, dated December 5,1980, counsel for Alabama Power Company reviewed its history of having cancelled plans for the construction of Alan R. Barton Nuclear Plant, Units 1, 2, 3 and 4 and requested withdrawal of its construction pemit apolications for tncse plants. Ti.e sites were located

along the west side of the Cosa River in Chilton and Elmore Counties, Alabama.

Units 1 and 2 were proposed for Chilton County and Unf ts 3 and 4 were pro-posed for Elmore County. A Notice of Receipt of Application for Construction Permits and Operating Licenses was published in the Federal Register on November 29,1974 (39 F. R. 4574).

By letter, dated February 18, 1981, applicant's counsel aavised that no work had been perfomed at the Barton sites.

The Nuclear Regulatory Commission had not issued a limited work authorization or construction pemits for the Bartoe

plants and no hearing on the matter had been held.

By " Order Pemitting Withdrawal of Application for Construciton Pennits and f

Terminating Proceeding", dated June 10, 1981, the NRC's Atomic Safety and Licen-sing Board terminated the proceeding.

In accordance with the applicant's request and with the " Order Permitting Withdrawal of Application for Cons *'JCtion Permits and Terminating Proceeding" and pursuant to 10 CFR $2.107(c), notice is hereby given that the application for construction permits for the Alan R. Barton Nuclear Plant, Units 1, 2, 3 and 4 have been withdrawn and that the proceeding in this matter is terminated.

Correspondence concerning this application will continue to be maintained at the Commission's Public Docur.ient Room,1717 H Street, N. W., Washington, D.C.

20E55 and for the next six months at the Clanton Public Library,100 First Street, Clanton, Alabama 35045.

ORDER PERMITTING WITH0RAWAL 0F APPLICATION'FOR CONSTRUCTION PERMITS AND TERMINATING PROCEEDING FOR ALAN R. BARTON NUCLEAR PLANT, UNITS 1, 2, 3 & 4 By OMer dated June 10, 1981, the Licensing Board in Alabama Power Company (Alan R. Barton Nuclear Plant, Units 1, 2, 3 and 4), Docket Nos. 50-524, 50-525, 50-526 and 50-527, granted the Applicant's motion to withdraw, with-out condition, the construction permit applications for Barton Units 1, 2, 3 and 4 ad to terminate the proceeding. The Staff, in its December 12, 1980 response to the Applicant's motion, had no objection to the motion and had determined that no conditions should attach to the withdrawal.

Since a nctice of receipt of the application haf been published in the Federal Register, you should cause to be publi;.hed in the Federal Register a notice of the withdrawal of the applications pursuant to 10 CFR 9 2.107(C).
