SECY-81-316 - REPORTING OF CHANGES TO QUALITY ASSURANCE PROGRAMS (Rulemaking Issue)

The Commission, by a 4-0* vote, approved with Commissioner Ahearne's modifications:

1.

publication in the Federal Register for 60 days comment of a notice of proposed rulemaking which would require licensees to bnplement the approved quality assurance program to report certain changes to_their quality assurance program which affect the program description approved by NRC.

Section 201 of the Energy Reorganization Act, 42 U.S.C.

85841, provides that action of the Commission shall be determined by a " majority vote of the members present."

Commissioner Gilinsky was not present when this item was affirmed, but had previously indicated that he would approve this item.

Had Commissioner Gilinsky been present, he would have affirmed his prior vote.

Accordingly, the formal vote of the Commission was 3-0 in favor of the decision..

SECY-81-220 - COMMISSION REVIEW OF - ALAB-603 (ST. LUCIE NUCLEAR POWER PLANT) (Adjudicatory Issue)

The Commission, by a 3-1* vote with Commissioner Gilinsky dissenting approved issuance of a Memorandum and Order which completes the Commission's review of certain issues raised by the decision of the Appeal Board in ALAB-603.

Commissioner Ahearne provided additional views and Commissioner Gilinsky provided separate views, both of which are to be attached to the Memorandum and Order.
