Upcn review of the "thicn of Conce med Scientists' Feply to Yet Ed and Staff Subcissiens en Valve Testing" (April 22, 1981),

and in particular, de attached " Affidavit of Ecbert D. Pollard," the Cerncamald new believes dat the infomatien recuested at Pages 5-6 of de Pollard affidavit (514) should be provided to de 3 card. This pcsition is not altered by " Licensee's Furder er.swer to de Unicn of Cr.ce=ed Scientists' Motica for 3 card Order en 31ock Valve Test Fesults" (Fay 11, 1981).

regarding the ability of the 'IMI-l block valve to perform its intended fx.ction. Rose ccncerns should be addressed en the record. Licensee cannot ignore these results by asserting that the PORV block valves perform to safety functicns, as supported by Licensee's testineny.

'Ihe fact is that the significance of the functions of the block valve is a discuted issue in this proceeding. LIS addressed.de safety functions of the FORV and the PChV block valve in the " Direct Testirony of Ecbert D. Pollard en Behalf of the Unicn of Concerned Scientists regarding CCS Contention 5."

The Board, in its discretion, elected to pursue UCS 6 due ~o the inportance of dese issues fer de safe operaticn of IMI-1. The Board has an independent obligation to ensure that a full record is developed on all i..portant safety issues in the proceeding, regardle.ss of da i

Finally, the Cuu.u.malth notes that the additicnal inforatien supplied in Enclosure 1 to Licensee's May 11,1981 'Turder Ansar" does

In fact, the additional inforraticn appears to ccaform with paragraph 3 of Mr. Pollard's affidavit, witich states:

All failures of block valves to close fully during the EPRI tests inwived a risratch betwen the valve closing force needed and the size of the rotor operacor or an incorrect torque switch setting. No valve failures, per se, w re inwived in these failures to close.

For the foregoing reascns, the Concertaalth of Pennsylvania reqtests that the relief outlined in paragraph 14 of the Pollard affidavit be granted.
