Summer Nuclear Station, ) Unit 1 ) NRC STAFF NOTICE OF APPEAL FROM PARTIAL BOARD ORDER FOLLOWING PREHEARING CONFERENCE Pursuant to 10 C.F.R. 52.714a(c), _the Staff hereby takes an appeal from the Licensing Board's " Partial Order Following Prehearing Conference", dated April 30, 1981 which: (1) erroneously admitted Fairfield United Action (FUA) as late intervenors in the proceeding pursuant to 10 C.F.R. 92.714(a) (Order 6t 12), (ii) erroneously admitted FUA contentions 1, 2 and 27 concerning nanagenent competence as issues in the proceeding (Order at 5-8,12), and (iii) erroneously admitted FUA contentions 7 through 13 concerning emergency planning as issues in the proceeding (Order 5-8, 12).
