SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENUMENT NO. 5 TO FACILITY OPERATING LICENSE NO. DPR-75 PUBLIC SERVICE ELECTRIC AND GAS COMPANY, ET.AL.
SALEM NUCLEAR GENERATING STATION, UNIT NO. 2 DOCKET NO. 50-311 On April 18, 1980, a License for fuel Loading and Low Power Testing was issued to Public Service Elactric and Gas Company (PSE&G), et.al. for the Salem Nuclear Generating Station, Unit 2.
Pursuant to 10 CFR 550.51, which requires that a fixed period of duration be established for all licenses, an expiration date of one year from date of issuance was set forth in paragraph 2.G of the Salem 2 license.
It was expected that the staff review of the application for license filed by PSEAG would be completed by that cate. On February 10, 1981, PSE&G subnitted a letter requesting extension of the expiration date of the license.
Since the issuance of the License for Fuel Loading and Low Power Testing, all outstanding issues have been resolved to the satisfaction of the staff except those relating to emergency planning. The results of the staff's review were discussed with the Comission on January 14, 1981 and are documented in Supplement No. 5 to the Commission's Safety Evaluation Report (NUREG-0517), dated January 31, 1981. At the J;nuary 14, 1981 Comission meeting, the Commission decided that it is now prepared to issue a full power license for Salem 2 pending an acceptable finding on emergency preparedness around the Salem site.
The NRC finding on emergency preparedness is in part based en Federal Emergency Management Agency (FEMA) findings on the adequacy of the Delaware and New Jersey State and local emergancy plans. At the January 14, 1981 Comission meeting, the "MA representative stated { hat FEMA's finding and determination with respect to the State and local plans would not be forth-coming until late April based on a projected emergency response exercise date late in March,1981, and on a need for further FEMA processing before issuing a judgment to the NRC on the adequacy of the plans.
Based on FEMA's schedules, the NRC will be unable to make an overall finding on the issuance of a full power license for Salem 2 until after the April 18, 1 " 1 expiration date of the Salem 2 Fuel Load and Low Power Testing License. Therefore, the staff concludes that these remaining actions are beyond the control of the licensee and, therefore, good cause has been shown for extension of the license expiration date to April 18, 1983.
Environmental Consideration We have determined that the amendment does not authorize a change in effluent types or total amounts nor an increase in power level and will not result in any sign!ficant environmental impact. Having made this determination, we have 8103120$ $

r further concluded that the amendrent involves an action which is insignificant from the standpoint of environmental impact and, pursuant to 10 CFR $51.5(d)(4),
i that an environmental impact statement or negative declaration and environmental 3
impact appraisal need not be prepared in connection with the issuance of this i
amendment.
Conclusion
{
t We have concluded, based on the considerations discussed above, that:
(1) because the amendment does not involve a significant increase in the probability or consequences of accidents previously considered and does not j
involve a significant decrease in a safety rargin, the amendment does not involve a significant hazards consideration, (2) there is reasonable 4
assurance that.the health and safety of the public will not be endangered i
by operation in the proposed manner, and (3) such activities will be con-i ducted in compliance with the Commission's regulations and the issuance of this amendment will not be inimical to the coneon defense and security or to the health and safety of the public.
