CRDER TO MCDIFY LICENSE I

, l C:moustion Engineering, Inc. at Hematite, Misscuri ("tne if censee') is the holder of Materials License No. SNM-33 issuec Oy the Nuclear Regulatory C emission

("the Commission).

The license authorizes tne possession anc use of u to 4100 kgs of U-235 (< 4.1% enrichment), 350 g of U-235 (> 4.1.4 enrienment), and 20,000 kg of source material.

The licensee fa:ricates icw-enricnec uranius fuel for L' Rs.

The current license was renewed on Maren 31, 1977, anc is cue to exofre en Maren 31, 1982.

II Sefore issuance of a license to operate, staff review of the acclication determined that the ifcensee can ecerate the facility in a safe manner.

Nonetheless, based on the lessons learned frcm the accicent at Three Mile Island-and new :erspectives en emergency precareeness and planning, the C:= mission has reevaluated the emergency preparedness requirements for its fuei cycle anc materials licensees. The Commissien has cecided that significant imcrevements need to be made premctly to ensure tnat adecuate ensite emergency rescense actions will be taken by licensees with major Ocerations in cases wnere, even thougn unlikely, pctantially sericus raciation accicents c:uld occur. 2 operations licensed to be carried out pursuant to Materials License No. SNM-33 accear to fall in :nis category anc require one cevelecment of a more ccmcrenensive onsite radiological contingency plan than previously sucmitted to the Ccamission for review.

Specifically, c:nsicerations are needed to ensure (1) tnat tne plant contains adecuata engineerec safety features and is otherwise cesignec to limit releases of radioactive materials and radiation excesures in :ne event of an accident, (2) nat a ca: ability exists for measuring anc assessing tne significance of accidental releases of racicactive materials, (3) tnat i

accrocriate emergency equipment and planning are proviced Onsite to protect norkers against radiation ha: arcs that mignt be encounterec following an accident, (4) that notifications are made promotly to feceral, state, anc local government agencies, anc (5) that necessary rec:very actions are taken in a timely fasnian to return :ne plant to a safe condition following an accident.

The information to te develoced and documented is cescribed in the enclosed

" Standard Format and Centent for Raciological Contingency Plans for Fuel Cycle and Materials Facilities" (Enclosure 1).

In summary, the information to be sucmitted to NRC for review incluces a (1) description of clant systems imcortant to safety; (2) cnaracteri:ation of classes of crecible emergencies that mignt occur; (3) descriction of radiological contingency measures for eacn class of emergency; (4) designation of authorities anc resconsibilities of key incivicuals anc groucs emoloyed cy the licensee; and.(5) a description of equipment anc facilities designated for use curir *at:ation emergencies. In precaring the plan, consiceration should be given to a set of credible accidents ranging from almost everyday occurrences of sma'l conse-quence through hignly imcrocaDie, but not imcossible, accidents such a, those resulting from severe natural phenomena, human error, and multiple ecuicment failures, and sacotage.

III In acdition to onsite radiological contingency planning, as discussed in Section II above, offsite emergency response planning is also hignly imcortant.

t Offsite planning requirements for fuel cycle and materials facilities are being developed secarately and will be consicered in a procesed rulemaking to ce puolished in the coming months. Within :ne framework of that rulemaking, NRC will carry out extensive coordination with state governments anc the Federal Emergency Management Agency (FEMA) concerning acplicable recuirements.

IV The Commission believes that it is prudent and..2cessary to recuire the licensee to develop and submit within ISO days of the effective cate of tais Orcer, or before, an ensite radiological contingency plan, as ciscussed in Section II acove, acclicable to operations licensed pursuant to Materials License No. SNM-33.

Such a plan can be developed and effectively imolemented scart from offsite emergency response planning, which necessarily involves state and local government emergency planning actions. The onsite raciological contingency plan is a necessary extension of protective actions

. taken by the licensee curing normal ocerations. Suen planning is essential to

4 ensure that pre er plans are made by the 'icensee to protect tne puolic feca accidents tnat could result frem the licensed operations. A lesson learned from tne Three Mile Is14nc accident is -.at accidents tacugnt to e nignly imorobable can and will occur, and tnat proper emergency precaredness is required to mitigate raciological c nsequences.

The reporting and recccc keeping part of this onsite raciological contin-gency plan is sucject to clearance by the General Accounting Office. GAO l

review and clearance will not stay the effective date of this Orcer as regards tne requirement that the licensee develoo tne plan. Unless advised to the contrary, GAO clearance will be effective within 45 days frem the cate of this Orcer.

V Accordingly, pursuant to sections 161b and 161o of the Atemic Energy Act of 1954, as amended, 540.41(e) of 10 CFR Part 40, $670.32(a)(3), 70.32(b)(2),

and 70.32(b)(5) of 10 CFR Part 70, and $2.204 of 10 CFR Part 2, IT IS HERE3Y ORDERED THAT within 130 days of the effective date of this Orcer, the licensee snall sucmit:
