In the course of its consideration of the appeals pending before it in the above-styled proceeding, the Appeal Board has taken note that the notice of opportunity for hearing on the application for a construction permit extension was signed by L.S. Rubenstein, Acting Chief, Light Water Reactors Branch 4, Division of Project Manage-ment, NRR.
See 44 Fed. Reg. 69061, 69062 (November 30, 1979).
The Board assumes that the notice was issued by Mr. Rubenstein under a delegation of authority to him.
Would you please confirm the correctness of this assump-tion in writing at your earliest convenience.
The Board would also-appreciate being advised as to the source of the delegntion to Mr. Rubenstein.
Needless to say, copies of your response should be served upon the other parties to the proceeding.
