presented by the Petition for Review filed by the applicants are not so difficult as to require briefing beyond the opposition which the Intarvenors have already filed.
In addition, for the reasons stated in their opposition thereto, the Applicants believe that the Petition for Review filed by the Intervenors does not present any issue worthy of the Commission's scrutiny.
Therefore we urge the Commission to exercise its discretion to deny the motion insofar as it seeks an opportunity for further briefing with respect to ALAB-924.

Intervenor's argue that this Commission is precluded by the pendency of a Petition for Review in the United States Court of Appeale for the District of Columbia Circuit' from reversing ALAB-924. 2 This simply is not in accord with prior agency precedent.
Tbe rule is that the agency, at most, will view itself to be precluded from acting to alter any ruling which is squarely before the Court of Appeals, but is free to act on any matter not squarely before the Court of Appeals.3 The only thing squarely before the Court of Appeals as a result of the Petition for Review relied upon is the issue of the correctness of LBP-L b

Thus, there
- 1. no bar to the Commission acting to reverse ALAB-924.

The question of whether to grant a housekeeping stay is i
also a matter committed to the sound discretion of the Commission.
We believe that in the circumstances of this case no i
housekeeping stay should be granted, and surely not the lengthy stay requested by the Intervenors.5 Respectfully submitted,
