On May 13, 1980 you requested a license to authorize the export of 5.0 kilograms of low enriched uranium for use'at the Instituto De Pesquisas
~Energeticas e Nucleares-San Paulo-Cidade Universitaria, Application number XSNM01683.- According to established procedures, your application'was referred to the Executive Branch for review and comment on May 23, 1980.
i As you are aware, circumstances existing since the passage of the Nuclear Non-Proliferation Act in 1978 have affected U.S. nuclear cooperation with Brazil. Accordingly, your application has been pending for many years.

-Recently, in a routine housekeeping move intended to make final disposition of long-pending, inactive applications, the Executive' Branch has advised us that the necessary determination for a reconnendation of approval of your' application under the Atomic Energy Act, as amended, cannot be made.
Pursuant to Section 126b.-of the Atomic Energy Act and NRC Rules and Regulations (10 CFR 110.44(d)), the Commission must deny any export license application for R
'which the Executive Branch judgement does not recommend approval.
For this reason, your application of May 13, 1980 (XSNM01683) is denied.

Dear Mr. Shea:
This letter is in response to the letter from your office dated May 23,-1980, requesting Executive. Branch views as to whether issuance of an. export license in accordance with the application hereinafter described meets the applicable criteria of.
the Atomic Energy Act of 1954, as. amended by the Nuclear Non-proliferation Act of 1978:
NRC 3k). XSNM01683 -- Application by Westinghouse Electric Corporation for authorization to export to Brazil 100 grams of U-235 contained in 5 kilograms of uranium enriched to a maximum of 3.2 percent in the form of Angra I-type fuel pel.!ets for analysis to confirm data related to fuel pellets contained in Angra I fuel assemblies.
The Executive Branch has reviewed the proposed export and concluded-that the necessary determinations for a recommendation of. approval under the Atomic Energy Act, as amended, cannot be made.
On the basis of the foregoing, the Executive Branch recommends that the request for a license be denied.
This recommendation is provided at this time to allow final disposition of a long-pending inactive application.
