Dear Mr. Millar:
I am writing in response to your letter of January 19, 1990, regarding denial of your request for a license to export 45,000 curies of tritium in sealed light sources.

As you know, the U.S. Government has certain nuclear proliferation concerns about the use of tritium to be used as light sources for runway landing lights, particularly when large amounts of tritium are incorporated in the individual light sources (i.e., over approximately 100 curies). This has precluded approval of such exports to date in the absence of 'more specific information concerning the individual end users and end-user locations. The same difficulty applies to your request to export 45,000 curies of tritium.
The Executive Branch was not prepared to recommend approval of an export to test a use of tritium which involved proliferation concerns.
In addition, your previous application, for export license XB001242, was for a. light source which contains a maximum of 120 curies of tritium per device. Your current application increases this quantity to 240 curies per device.
It was therefore not considered a " renewal" of your expired license XB001242, as you
. stated in your letter of January 19.
Indeed, the increased size of the light source was.a major source of concern to the Executive Branch.
While your license application as submitted cannot be granted, the NRC and the Executive Branch are prepared to consider more specific requests.for export licenses to individual. countries with detailed end-use information.
But for the-present, we must abide by the decision of the Executive Branch that a determination cannot be made that the statutory export licensing criterion of non-inimicability to the common defense and security is met for an'open-ended license such as you requested.
