f MOTION To FILE A SUPPLEMENTAL BRIEF Under date of January 16, 1990, the Attorney General of The ,

Commonwealth of Massachusetts, the Seacoast Anti-Pollution League, and.the How England Coalition on Nuclear Pollution (hereinafter i collectively "Intervanors") filed a document styled as ,

"Intervenors (sic) Motion for Leave to File a Supplemental Brief

-in Support of Their November 13 and December 1, 1989 Motions for Mandatory Relief" (hereinafter " Motion"). Accompanying the Motion -

was "Intervenors (sic) Supplemental Brief in Support of Their  :

November 13 and December 1, 1989 Motions for Mandatory Relief"  ;

(hereinafter " Supplemental Brief"), the document which the Motion -

seeks-to have the Commission accept for consideration. The Motion should be denied, and the supplemental Brief reiected, for the following reasons:

1. On November 16, 1989, the Commission set the schedule for all further briefing on Intervenors' various attempts to block the issuance of the full-power operating license authorized by the Licensing Board on November 9, 1989. In its unpublished order, the Commission specifically stated that "(N)o further replies to answers will be considered." Intervenors' " Supplemental Brief" is a thinly-disguised effort to evada that order and, pursuant to the Commission's prior unambiguous statement, should not be received

-for consideration.

2. The Motion purports to be premised on the theory that the procedural order issued by the Licensing Board on January 11, 1990, in which that Board solicited the parties' views as to how it should proceed with whatever further resolution might be necessary as to the issues remanded to it in ALAB-924, suddenly revealed that "the November 9 license authorization was not made pursuant to 10 C.F.R. 50.47 (c) (1) . "1 This argument, however, is based upon a wanton misreading of the Licensing Board's order, as ,

well as a complete disregard of the decisions which preceded it '

and the agency precedent on point.2 The Licensing Boards order does not in any way retract the Board's prior detailed and ,

persuasive findings that the four remanded issues were not Motion at 1 2.

2 Moreover, the abusive and sneering tone of the brief (mag., "the Licensing Board's misleading language immediately identifies its author," Supplemental Brief at 1 2), provides an -

additional reason why it should be summarily discarded. 10 C.F.R. 2.713.
